real-e is a technology platform. It provides tools and services that support a transparent, event-based process for marketing and selling residential property in Ontario, including coordinated marketing, a defined bidding event, and seller-directed sharing of competing offer information as permitted under Ontario law.
real-e is not a real estate brokerage, real estate agent, broker or salesperson, and does not hold itself out as one. real-e does not provide real estate brokerage services, does not act as your agent, and does not provide legal, financial, tax or appraisal advice. Where a registrant, brokerage or other licensed professional is involved in a transaction, that relationship is separate from your use of real-e.
You must be at least 18 years old and legally able to enter into a contract to use real-e. Our services are directed at property located in Ontario, Canada.
You are responsible for the accuracy of the information you provide and for keeping your account credentials secure, and for activity under your account. Tell us promptly if you believe your account has been used without your permission.
You agree not to use real-e to break the law, to infringe anyone's rights, to submit false or misleading information, to interfere with the platform's operation or security, or to collect data from it by automated means without our written permission.
Information displayed on real-e, including any current bid, timetable or property details, is provided for information only and may change. Where a reserve applies it is confidential and set by the seller. Participation in a bidding event does not by itself create a binding agreement of purchase and sale — the terms of any sale are governed by the documents the parties sign.
Results vary. real-e does not guarantee that a property will sell, or any particular sale price, timing, level of interest or outcome.
Fees for real-e's services are set out in the agreement you enter into with us before your property is marketed. Fees quoted in marketing materials are illustrative, are subject to HST, and exclude buyer-agent compensation and other costs of selling, which are separate.
By registering you agree that we may contact you about your enquiry by email and telephone. Text messaging is optional and is governed by our SMS Terms at real-e.ca/sms-terms. Our handling of personal information is governed by our Privacy Policy at real-e.ca/privacy.
The real-e platform, its content, branding and software are owned by Real E Simple Inc. or its licensors. You may not copy, reproduce or create derivative works from them without our written permission. You keep ownership of the content you submit and grant us a licence to use it to provide the service.
The platform may link to or rely on third-party services. We are not responsible for their content, availability or practices.
The platform is provided "as is" and "as available." To the maximum extent permitted by law, we exclude all implied warranties, and Real E Simple Inc. is not liable for indirect, incidental, special or consequential losses, or for lost profits or lost opportunity, arising from your use of the platform. Nothing in these terms limits liability that cannot be limited by law.
You agree to indemnify Real E Simple Inc. against claims arising from your breach of these terms or your misuse of the platform.
We may suspend or end your access if you breach these terms or if we reasonably believe your use poses a risk to the platform or to other users.
We may update these terms. The "last updated" date shows when. Continuing to use real-e after a change means you accept the updated terms.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction.
